Warranties for actual garage door repair, installation, or maintenance services are provided separately as part of individual service agreements and are not governed by these Terms.

8. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL GARAGE DOOR USA, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

• Your access to or use of (or inability to access or use) the Site
• Any conduct or content of any third party on the Site
• Any content obtained from the Site
• Unauthorized access, use, or alteration of your transmissions or content

In no event shall our total liability to you for all claims arising from or related to the Site exceed one hundred dollars ($100.00).

9. Indemnification

You agree to defend, indemnify, and hold harmless Garage Door USA, its officers, directors, employees, and agents from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys’ fees) arising out of or relating to your violation of these Terms or your use of the Site.

10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of New Jersey, without regard to its conflict-of-law provisions. Any legal action arising out of or related to these Terms or the Site shall be brought exclusively in the state or federal courts located in Hudson County, New Jersey, and you consent to the personal jurisdiction of such courts.

11. Dispute Resolution

In the event of any dispute arising from or relating to these Terms or the Site, you agree to first attempt to resolve the dispute informally by contacting us at info@garagedoor.us. We will attempt to resolve the dispute informally within 30 days.

If the dispute cannot be resolved informally, either party may pursue the matter in the courts described in the Governing Law section above. Nothing in this section prevents either party from seeking injunctive or other equitable relief from the courts for matters related to data security, intellectual property, or unauthorized access.

12. Termination

We may terminate or suspend your access to the Site immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach these Terms. Upon termination, your right to use the Site will immediately cease. All provisions of the Terms that by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

13. Changes to Terms

We reserve the right to modify or replace these Terms at any time at our sole discretion. When we make material changes, we will update the “Effective date” at the top of this page. It is your responsibility to review these Terms periodically for changes. Your continued use of the Site following the posting of any changes constitutes acceptance of those changes.

14. Severability

If any provision of these Terms is held to be unenforceable or invalid by a court of competent jurisdiction, that provision will be enforced to the maximum extent permissible, and the remaining provisions will remain in full force and effect.

These Terms, together with the Privacy Policy, constitute the entire agreement between you and Garage Door USA regarding the use of the Site and supersede any prior agreements or understandings, whether written or oral, relating to the subject matter herein.
